Welcome to our Legal page! Yes, we know, these things can be as dry as month-old corn starch but they're important so please take a moment. We’ve put everything in one place and made it easy for you to read and move around as needed.
Presented here are our six (6) company operating policies on a single page.

We believe these policies to be compliant, fair, and transparent in all regards. We are committed to protecting your privacy, clearly explaining how We do business and what Our expectations of you are, being open about whom we do business with, explaining how you may and may not use our content, and having websites that are accessible to all. We have crafted our policies to reflect all these thoughts.


GENERAL

FEAST Brands, LLC, is a limited liability company ("We", "Us”, “Our”, or "FEAST") registered in the State of Maryland in the United States. My FEAST & Me is a related blog site owned and managed by FEAST Brands, LLC. The website addresses are www.feast-brands.com and www.feast-brands.com respectively (collectively, the “Sites” and individually, the “Site”). Both Sites and Our related social media contain informational material primarily related to the art of food and culinary entrepreneurship (collectively, the “Content").

Your access to the Sites’ Content, related social media, and any associated stores or interactive features (collectively, the "Services") is subject to Our six (6) company operating policies: General, Privacy + Cookies, Terms of Use, Disclaimers & Disclosures, Copyright & Usage, and Accessibility.

IN A NUTSHELL, BY BROWSING, ACCESSING, REGISTERING FOR, FOLLOWING, DOWNLOADING INFORMATION OR PURCHASING MERCHANDISE FROM, OR OTHERWISE INTERACTING WITH ANY OF OUR SITES OR RELATED SOCIAL MEDIA, YOU AGREE TO THE SIX (6) COMPANY OPERATING POLICIES PRESENTED HEREIN (COLLECTIVELY, THE "TERMS").

You represent that you are at least 18 years old and are able to enter into these Terms.

If you discover you are not particularly enamored with Our Terms, you should not use the Sites or related social media in any way.

FEAST Brands, LLC Consulting Agreement
Clients who enter into a formal consulting agreement with FEAST Brands, LLC (yea! let's start a food business!) have unique terms and conditions that may contradict these Terms. For example, a formal consulting agreement may permit the use of certain recipes or copyrighted material owned by Us. If a provision of a formal consulting agreement is found to conflict with any of these Terms, the terms in the formal consulting agreement will apply.

Modifications
We may change or amend any of these Terms at any time without formal promulgation (what a great word!). You'll be able to tell if We've changed or amended anything by the presence of a new effective date at the beginning of any affected Section. Any subsequent use of the Sites or Services by you means you've accepted these changes or amendments. We also may modify or discontinue, temporarily or permanently, the Sites and any related social media, or any features or portions thereof, without formal promulgation (used it again!).

No Third-Party Beneficiaries
These Terms are for the benefit of, and will only be enforceable by you and Us. No besties, no BFFs can get involved. Nothing here is intended to involved a third party in any way.

Miscellaneous
No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, nor do you have any authority to bind Us in any respect whatsoever. It is what it is.

These Terms constitute the entire agreement between you and Us regarding the use of Our Sites and related social media. Just because we decline to exercise or enforce a particular Term now does not constitute a waiver because the next time we might.

These Terms are not assignable, transferable, or sublicensable by you, except with Our written consent. You can't pass these off on someone else.

Major and minor headings used to separate the Terms herein do not have any substantive meaning or interpretive value. They are simply here to make a very dry technical document easier to read.

Governing Law
Any claim relating to FEAST Brands, LLC’s Sites or related social media must be governed by the laws of the State of Maryland without regard to its conflict of law provisions. All interactions between Us regarding any disputes or controversies will be here in the Old Line State.

Arbitration
If the Parties are unable to resolve any dispute or controversy through informal negotiations arising out of or relating to any interpretation, construction, performance, termination or breach of these Terms, the dispute or controversy will be settled by final and binding arbitration by a single arbitrator to be held in Westminster, Maryland, in accordance with the American Arbitration Association national rules for resolution of employment disputes then in effect, except as provided herein. The arbitrator selected shall have the authority to grant any party all remedies otherwise available by law, including injunctions, but shall not have the power to grant any remedy that would not be available in a state or federal court. The arbitrator shall have the authority to hear and rule on dispositive motions (such as motions for summary adjudication or summary judgment). The arbitrator shall have the powers granted by Maryland law and the rules of the American Arbitration Association which conducts the arbitration, except as modified or limited herein.

Severability
If any individual provision of these Terms is held by an arbitrator or court of competent jurisdiction to be void, invalid, or otherwise unenforceable, that provision must be limited or eliminated to the minimum extent necessary so as not to affect the remaining provisions that must otherwise remain in full force and effect and enforceable. Basically, one stale ingredient can't bring down the whole bouillabaisse.

PRIVACY + COOKIES

We understand that your privacy is really important to you and that you care about how your information is used and shared online. Please know we do as well! This section is designed to acquaint you with Our policies so that you can make an informed decision regarding your use of Our Sites and related social media.

Our overall position regarding data privacy is to collect only that which is absolutely necessary to accommodate whatever it is you have requested from us, for example, to receive our recipe or other blog posts. It is also our position to, in good faith, commit to doing whatever we can to abide by what has become a byzantine array of privacy regulations. Finally, We will never willfully disclose, sell, or rent any individual information about you, including email lists, to anyone unless you give Us permission to do so or we are compelled by law.

This section applies to our use of all data collected by Us in accordance with your use of our Sites. Please be sure to carefully read it carefully and ensure that you understand it. YOU ARE CONSIDERED TO HAVE ACCEPTED THE TERMS IN THIS SECTION AND ELSEWHERE ON THIS PAGE WHEN YOU FIRST USE OUR SITES AND RELATED SOCIAL MEDIA. You should not use the Sites and related social media in any way if you are unwilling to accept them.

We collect and process information in ways that are consistent with your rights and our obligations under the law, which is to say, we collect usage data so that we can continually improve your experience on our Sites. Namely, we collect and process data:

  • When necessary for the performance of a contract or other agreement, to which you are a party (for example, if you request something We will need to collect an email address to send it to you)
  • When necessary for compliance with a legal obligation
  • When necessary in order to protect your vital interests or that of another natural person
  • When necessary for the purposes of other legitimate business interests pursued by Us, except where such interests are overridden by your interests under the law

No registration is required to view Our Sites and related social media, however, you are encouraged to leave your email in any of the provided fields on the Sites and related social media to receive future communications from Us, such as Our recipe and other posts, newsletters, or special offers. We will never spam you!

No billing information of any kind is stored on the Sites because we don't currently sell anything.

Personal Information Collected on the Sites
NO PERSONALLY IDENTIFIABLE INFORMATION IS COLLECTED WHEN YOU BROWSE OUR SITES AND RELATED SOCIAL MEDIA. The only personally-identifiable information collected on the Sites and related social media is gathered in the comment area or on specified sign-up forms, where fields are provided for you to voluntarily provide your name and email address to leave a comment or to receive our emails with blog posts, newsletters, or special offers. We collect this information so that We can respond to the comments or questions that you post or send you the information you may have requested. Please see the table below for additional details on how We collect and use personally identifiable information.

Anonymous Information Collected on the Sites
WE RECORD ANONYMOUS DATA. Most of the information that we collect from the Sites is anonymous information, such as the pages you visit. Other anonymous data we may collect might include the name of your internet service provider, the website that you used to link to our Sites, other interests you have, basic demographic information, the websites that you visit from our Sites, and your internet protocol address. The data are used for statistical purposes, but you, as the individual user, remain anonymous. OUR SITES AND RELATED SOCIAL MEDIA MAY CONTAIN EMBEDDED CONTENT (E.G., VIDEOS, IMAGES, ARTICLES, ETC.). Embedded content from other websites behaves in the exact same way as if you had visited the other website directly. These websites may collect data about you, use cookies, embed additional third-party tracking, or monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Links to Other Sites
OUR SITES AND RELATED SOCIAL MEDIA MAY CONTAIN LINKS TO AFFILIATE AND OTHER WEBSITES. We do not claim nor accept responsibility for any privacy policies, practices, or procedures of these other websites. Therefore, if you choose to visit one of these other websites, We encourage you read and understand their privacy statements. This Privacy Policy applies only and solely to the information collected by OUR Sites and related social media. Through affiliate links, identifying information may be carried over to an outside website to show that you visited that website from our Sites to ensure proper commissions are issued.

My FEAST & Me, through FEAST Brands, LLC is, or may in the future become, a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for websites to earn advertising fees by advertising and linking to Amazon.com .

Whom We Share Your Data With
We contract with the third parties listed in the table above to supply products and services, and hopefully provide a more enjoyable user experience on our behalf. These may include payment processing, delivery of goods, search engine facilities, advertising, and marketing. In some cases, these parties may require access to some or all of your data. When that is the case, We take all reasonable steps to ensure that your data is handled safely, securely, and in accordance with the law.

How Long We Retain Your Data
If you leave a comment on the My FEAST & Me Site, the comment and its metadata are retained indefinitely. This is so We can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

We may allow you to register on our Sites now or in the future. If that feature is available, We store the personal information you provide in your user profile. You can see, edit, or delete your personal information at any time (except you typically cannot change your username without contacting Us). Website administrators can also see and edit that information.

Information collected using Google Analytics may be retained for the current system limit of up to 26 months.

Information submitted through forms, such as email forms or contact forms is retained until such a time as you choose to unsubscribe or invoke your right under the General Data Protection Regulation to be forgotten.

What Rights You Have Over Your Data
If you have an account on the Sites or have left comments on the Sites, you can request to receive an exported file of any personal data we have for you, including any data you have provided to us. You can also request that we erase any personal data we have about you. This does not include any data we must keep for administrative, legal, or security purposes. Similarly, if you have subscribed to our email list you can unsubscribe at any time and also request We delete any personal data in the marketing email client database by sending us a note at info(at)feast-brands.com.

Rights of California Residents
If you reside in California, the California Consumer Protection Act gives you the right to ask if We sell or disclose your personal information to third parties. WE DO NOT SELL PERSONAL INFORMATION TO THIRD PARTIES, NOR HAVE WE EVER SOLD PERSONAL INFORMATION IN THE PAST. California law also gives you the right to opt out of such sales, however, in this case, it’s a moot point because We don’t do that.

Additional Rights of EEA (European Economic Area) Residents
If you are a resident of a country in the EEA, you have additional rights to (a) access your personal data, (b) ensure the accuracy of your personal data, (c) have Us delete your personal data, (d) restrict further processing of your personal data, and (e) complain to a supervisory authority in your country of residence responsible for data protection in the event you believe your data are being misused. BY BROWSING OR INTERACTING WITH EITHER OF OUR SITES OR RELATED SOCIAL MEDIA IN ANY WAY, YOU ARE CONSENTING TO OUR TERMS OF USE AS OUTLINED IN THIS SECTION AND ELSEWHERE ON THIS PAGE. You should not use the Sites in any way if you are unwilling to be bound by these Terms. You agree to be bound by all applicable laws and regulations. The materials contained on the Sites are protected by applicable copyright and trademark law. All rights reserved.

Use of Our Sites and Related Social Media
This is the grant of a license, nothing else. Under this license and subject to your compliance with these Terms, you are only allowed to make personal, non-commercial use of Our Sites and related social media. Other privileges may be available to you as described in our Copyright & Usage Policy. We may revoke any privilege at any time at Our sole discretion.

The Sites and related social media may contain links to third-party websites on the internet that are owned and operated by other entities and that are not governed or controlled by Us in any way. You agree We have no control and are not responsible for the content, operation, or functionality of these sites. You agree to hold Us harmless from any liability related to your use of any third-party website.

Electronic Communication
When you use the Sites and related social media, or send emails to Us, you are communicating with Us electronically. You consent to receive communications from Us electronically. We will communicate with you by e-mail or by posting notices on the Sites or through our other services such as related social media. You agree that all agreements, notices, disclosures, and other communications that We provide to you electronically satisfy any legal requirements that such communications be in writing.

FEAST Brands, LLC owns all Content on the Sites and related social media, which United States and international copyright laws protect. All rights reserved. You expressly agree not to reproduce, publish, transmit, distribute, sell, license, modify, or create derivative content from any part of the Sites without prior written consent from Us.

We prohibit the use of any of Our trademarks or service marks for any reason without our express written consent. Nothing in these Terms is deemed to grant to you any license or right in or to any of Our patents, copyrights, trademarks, service marks, trade secrets, other proprietary rights, or otherwise.

Comments
The My FEAST & Me Site – as well as any related social media managed by Us – may offer the opportunity for you to engage in discussion by leaving comments related to the Site’s Content and posts only. It is NOT an open forum for unrelated topics. You must not post or transmit through the Site or related social media any material this is unrelated to the Sites’ Content. Specifically, we do not tolerate and will delete the following types of content from the Site and related social media:

  • harassment directed toward anyone
  • unsolicited electronic communications such as “spam”
  • self- or commercial promotion of any company, product, or service
  • political extremism or hate speech
  • defamatory or libelous statements regarding Us or any third party
  • anything that falsely states or implies sponsorship or endorsement by Us
  • any injurious formulas, recipes, or instructions that may encourage criminal conduct
  • references to illicit or alarming acts
  • comments that may violate the legal rights of a third party or,
  • anything that would otherwise interfere with another’s enjoyment of the Sites

Our sole discretion will be used to determine if a comment violates this Section. We will delete any comments found to be in violation and no further explanation will be due to you.

Feedback
You may have the opportunity to voluntarily submit, in any form or manner, questions, comments, suggestions, reviews, ideas, plans, designs, notes, proposals, drawings, original or creative materials and other information regarding the Sites and related social media, Us or our products or services (collectively, the "Feedback"). You agree that the Feedback is non-confidential and becomes Our sole property upon receipt. We must own the exclusive rights, including all intellectual property rights, in and to such Feedback and must be entitled to the unrestricted use and dissemination of the Feedback for any purpose, commercial or otherwise, without any acknowledgment or compensation to you.

Accounts and Purchases on the Sites
Individual accounts and product purchases are not currently available or possible on the Sites.

Termination
You may terminate the Terms at any time by discontinuing your use of the Sites and related social media and providing Us with a notice of termination at info(at)feast-brands.com. Any subsequent use of the Sites and related social media will automatically reinstate the then-current Terms. We reserve the right, without notice to you and in Our sole discretion, to terminate your right to use the Sites, or any portion of the Sites, and to block or prevent your future access to the Sites or any portion of the Sites. Upon termination by Us or you, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Indemnification
To the fullest extent permitted by applicable law, now and in the future, you agree to defend, indemnify, and hold Us (and any of our related business associates) harmless, from and against any claim or cause of action (collectively, "Claims") arising out of, or in any way related to (a) your violation of any provision of any of these Terms, (b) your access to and use or misuse of the Sites, Products, or Services, or any of the Content contained therein, (c) any content you post, upload, or otherwise transmit on or through the Sites in any way, (d) your violation of any rights of another, or (e) your violation of any applicable law.

You agree to promptly notify Us of any third-party Claims, cooperate with Us in defending such Claims, and pay all fees, costs, and expenses associated with defending such Claims (including but not limited to reasonable attorneys' fees and expenses). You further agree that We must have the sole right to control of the defense or settlement negotiation of any third-party Claims. You must not settle any third-party claim or waive any defense without our prior written consent.

Exclusivity of Remedy & Limitation of Liability
Your sole and exclusive remedy, and Our sole and exclusive liability, for any breach of warranty, must be your right to return the product or receive a refund (if applicable) for the service. There is a lot in this paragraph so let's all hold our collective breaths and meet up at the other end.

YOU AGREE THAT UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY, OR ANY OTHER DAMAGES ARISING OUT OF YOUR USE OF THE SITES AND RELATED SOCIAL MEDIA, PRODUCTS, OR SERVICES. ADDITIONALLY, WE ARE NOT LIABLE FOR DAMAGES IN CONNECTION WITH:
(I) ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, DENIAL OF SERVICE, ATTACK, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, OR LINE OR SYSTEM FAILURE;
(II) LOSS OF REVENUE, ANTICIPATED PROFITS, BUSINESS, SAVINGS, GOODWILL OR DATA; AND
(III) THIRD-PARTY THEFT OF, DESTRUCTION OF, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF YOUR INFORMATION OR PROPERTY, REGARDLESS OF OUR NEGLIGENCE, GROSS NEGLIGENCE, FAILURE OF AN ESSENTIAL PURPOSE AND WHETHER SUCH LIABILITY ARISES IN NEGLIGENCE, CONTRACT, TORT, OR ANY OTHER THEORY OF LEGAL LIABILITY.

THE FOREGOING APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF OR COULD HAVE FORESEEN THE DAMAGES. IN THOSE STATES THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR THE DAMAGES, OUR LIABILITY IS LIMITED TO THE FULLEST POSSIBLE EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL PURCHASE PRICE OF THE SERVICE OR PRODUCT YOU HAVE PURCHASED FROM US, AND IF NO PURCHASE HAS BEEN MADE BY YOU OUR CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED $100.
THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT LIMIT OR EXCLUDE OUR OR OUR RELATED PARTIES' GROSS NEGLIGENCE, FRAUD, INTENTIONAL, WILLFUL, MALICIOUS OR RECKLESS MISCONDUCT.

You also agree that our remedy at law for any actual or threatened breach of these Terms would be inadequate and that we must be entitled to specific performance or injunctive relief, or both, in addition to any damages that we may be legally entitled to recover, together with reasonable expenses of any form of dispute resolution, including, without limitation, attorneys' fees and expenses. No right or remedy of ours will be exclusive of any other, whether at law or in equity, including, without limitation, damages, injunctive relief, and attorneys' fees and expenses.


DISCLAIMERS & DISCLOSURES

Culinary Information
You are fully responsible for any actions you take and any consequences that may occur as a result of any Content you read or consume on the Sites and any related social media managed by Us. The Sites and related social media may provide limited and approximate nutritional Content or other information or data through blog posts, sample product descriptions, or otherwise for convenience and as a courtesy only. Nutritional data is gathered primarily from the USDA Food Composition Database by way of MasterCook culinary software or other online calculators.

Please note nutritional data can vary for any particular recipe based on factors such as precision of measurements, brands, ingredient freshness, similar-but-not-same ingredient, end-use of sauces, marinades, dressings, and reductions, or the source of the data. We obviously strive to keep all Content as accurate as possible but make no warranties regarding its accuracy.

Also, no statements contained in Our Content have been evaluated by the Food and Drug Administration. Nothing about the Content is intended to cure, prevent, diagnose, or treat any disease. You should consult your personal healthcare provider regarding any health-related decisions including altering your diet in any way. We must not be liable for adverse reactions or any other outcomes resulting from following the information found in the Content. Any action(s) you take based on the Content is strictly at your own risk. We are not liable for any losses or damages related to actions or failure to act related to the Content on the Sites and related social media.

Professional Disclaimers
No employee of Ours is professionally trained in medicine or as a professional dietitian or nutritionist. Any culinary recommendations made by Us about food preparation or otherwise are made based on our research or personal experience, and are most likely applicable, but must not be construed as medical, dietary, or nutritional advice.

Note: We occasionally consult with professional dietitians and nutritionists to offer the best Content we can. We can readily refer you to any of them, however, the relationship must be strictly between you and the dietitian or nutritionist, who will warrant their own credentials and experience independently of Us. We must not under any circumstances play any role in that relationship beyond the referral. It is your sole responsibility to assess the appropriateness of the dietitian’s or nutritionist’s advice.

No employee of Ours is trained as a professional lawyer or government regulator.
